Introduction
James Pearce-Smith represented defendants in substantial claim (>£1m) for damages for misrepresentation and breach of warranty brought by the overseas purchaser of the majority of shares in a Birmingham waste recycling company. The claim involved allegations of fraud, and raised complex issues concerning causation and quantum of loss, taking into account the price-adjustment mechanisms of the share purchase agreement. James settled the pleadings, and appeared at various interim hearings and the 2 week trial in the High Court.
